The Union Finance Ministry recently provided relief to several industries, including automotive, data hosting services, and advertising agencies that work with foreign clients. One key circular clarified that demo vehicles used by dealers for test drives can still qualify for GST deductions, as they support vehicle sales. Another circular recognized data hosting services provided by Indian companies to international cloud providers as exports, thereby exempting them from GST. Additionally, exporters were assured that they could claim refunds on Integrated Goods and Services Tax (IGST) paid on imported inputs. The circulars aim to boost these sectors, clarifying tax obligations and supporting growth.



Union Finance Minister Nirmala Sitharaman has announced new measures aimed at providing relief to several key sectors, including the automotive industry, advertising agencies, data hosting service providers, and exporters. The announcement was made through a series of circulars by the Central Board of Indirect Taxes and Customs (CBIC), which were released on Wednesday.

One notable circular clarified the status of demo vehicles used by authorized dealers. The circular stated that since these vehicles are utilized for trial runs and demonstrations to potential buyers, they play a significant role in driving sales. Consequently, these demo vehicles can still be considered as tools for making taxable supplies, allowing dealers to retain their Goods and Services Tax (GST) deductions, even if the vehicles are capitalized in their accounts.

Harpreet Singh, a partner at Deloitte India, praised the circular’s analysis, emphasizing that demo vehicles indeed facilitate sales and thus qualify for credit under GST regulations.

The circulars also touched on data hosting services provided by Indian companies to foreign cloud computing providers, which previously faced GST liabilities as they weren’t classified as exports. New clarifications now recognize these services as exports, provided certain conditions are met, alleviating the tax burden on these service providers.

Moreover, the circulars addressed the situation for exporters who import inputs with customs benefits but later pay taxes. In such cases, these exporters will be eligible for refunds on the output GST paid on their exports, which is expected to enhance their operational efficiency.

Finally, the government provided clarifications regarding advertising services for foreign clients, evaluating whether these agencies act as intermediaries. The findings suggest that the services delivered can qualify as exports, thereby exempting them from GST.

With these initiatives, the finance ministry aims to bolster sectors critical to economic growth, providing the necessary support for businesses navigating the complexities of GST regulations.
