An Indiana judge has settled a long-standing debate between a restaurant owner and the county commission by ruling that “tacos and burritos are Mexican-style sandwiches.” Martin Quintana, the proprietor of Famous Taco, a Mexican restaurant in Fort Wayne, sought zoning approvals to upgrade his establishment. The approval required his restaurant to be a “sandwich bar-style” facility serving “made-to-order” or “Subway-style” sandwiches, excluding fast food chains like Arby’s and McDonald’s.

After years of legal battles, Judge Craig Bobay of the Allen Superior Court ruled in favor of Famous Taco, stating that the restaurant met the terms of the original commitment. Bobay declared that tacos and burritos are indeed Mexican-style sandwiches and that other culturally authentic restaurants could operate under the same conditions.

The ruling allows for the possibility of Greek gyros, Indian naan wraps, or Vietnamese banh mi restaurants to operate if they comply with the specified conditions. USA TODAY reached out to Famous Taco and the Fort Wayne Plan Commission attorneys for comments.

The decision brings an end to a legal saga that revolved around the definition of a sandwich and opens the door for a broader range of restaurants to operate in the area.
